www.marinesafaris.co.za Marine Safaris Standard Terms & ConditionsYour booking / reservation with Marine Safaris is made subject to the conditions listed in this document. In the conditions listed Marine Safaris shall mean Marine Safaris cc CK 97/42556/23 and ´You or Your´ shall mean any Person, Organization or Company that makes a booking or reservation that results in the partaking of any travel related services that includes activities, excursions, tours, transportation services or accommodation services arranged by Marine Safaris. Group bookings conditions will apply to any group / tour where more than 4 clients book or reserve travel services on one invoice and receive a special group rate. By partaking in any of these travel related services you agree, accept and confirm that you have read and understand the conditions and will be bound by these conditions either by signed invoice or by payment received on said invoice regardless of receipt of signed confirmation or not. QuotesAll prices quoted to you by Marine Safaris or its agents are based on prices quoted by service providers at the rate of exchange on the date of quotation. Marine Safaris shall not be held responsible for valid price increases in accommodation, services or airfares and, or exchange rate fluctuations and therefore reserves the right to adjust it´s prices accordingly. ReservationsReservations made more than 60 days prior to departure / arrival date must be secured by a non-refundable 30% deposit, of the total cost of the booking, within 48hrs of receipt of invoice as failure to do so will nullify the quotation. The full balance of the price must be paid no later than 60 days prior to departure / arrival date. Full payment is required for reservations or bookings made within 60 days prior to departure / arrival date. In all cases Marine Safaris reserves the right to cancel all reservations if the total price as per quotation have not been paid by you to Marine Safaris 60 days prior to departure / arrival date. In which event all amounts paid by you to Marine Safaris shall be forfeited and may be retained by Marine Safaris as liquidation damages. Late Booking FeeIn the event of a reservation being within 30 days of departure / arrival date Marine Safaris reserves the right, at it´s discretion, to charge a late booking fee of no more than R250 to cover the high costs of overseas telephone communication. Group Booking AmendmentsDue to the extra cost involved, Marine Safaris shall, in all cases reserve the right to charge a R100 levy for each occasion that you wish to amend a confirmed reservation i.e. deposit received. Amendments to the reservation will be accepted by Marine Safaris prior to 45 days of departure / arrival date on the condition that prices quoted for the reduced numbers of people will apply. In the event of the minimum number being exceeded a complete cancellation of the quote will apply. Should this cancellation apply and you are not prepared to accept the additional costs per person and the cancellation takes place within the 45 day period prior to departure / arrival date all amounts paid by you to Marine Safaris shall be forfeited and may be retained by Marine Safaris as liquidation damages. Delays and / or CancellationsMarine Safaris shall not be held responsible for any delays and / or cancellations either prior to departure or during your Tour, Safari or trip, regardless of whether caused by technical or mechanical failure, weather, strikes or any other circumstances whatsoever, foreseen or unforeseen. All expenses incurred relating to unscheduled extensions for hotels, meals, flights, transfers, telephone calls, clothing, toiletries etc. will be for your own account. Itinerary VariationsAlthough Marine Safaris will make every effort to ensure that published and / or quoted itineraries are provided, Marine Safaris reserves the right to make changes, if at it´s discretion, it considers it to be in your best interest to do so or if unforeseen circumstances result in this becoming necessary. Such changes or variations to the itinerary do not constitute you the grounds to cancel, claim or the rights to a refund. Passports, Passport Numbers, Visas, Flight Confirmations & InoculationsYou should have or obtain a valid passport at your own expense that is valid for at least 6 months prior to departure date and have sufficient open pages. Due to Foreign Exchange controls the Names, Passport Numbers and Physical Addresses of all those in your group must be provided to Marine Safaris, prior to deposit payment or together with payment. Marine Safaris will inform you, if Visas or inoculations are required. Unless you have requested and paid Marine Safaris in full, to obtain your visa, you will be responsible for obtaining them yourself at your own expense. You are fully responsible for reconfirming your flights at least 72 hour prior to departure. Marine Safaris shall not be responsible for any consequences whatsoever arising from your failure to comply with passport, health, driver license, flight confirmation or any other requirements. Responsibility Clause / LiabilitiesMarine Safaris and or it´s Agents acts as an agent in developing, operating and selling Tours, Safaris, Packages and travel arrangements and as these are not under the control or management of Marine Safaris, and as such Marine Safaris shall not be liable for any loss, damage, injury, accident, medical expense, illness, death, delay or any other irregularity resulting from defective transportation, recreational equipment or by error or default of any other person or body corporate engaged in conveying you and in carrying out travel arrangements for you, or otherwise in connection therewith, or from whatsoever cause. Marine Safaris shall in addition not be liable to you for consequential losses or damages you may suffer. Marine Safaris makes every effort to ensure that all arrangements and services connected with the travel programmes will be carried out as specified in the most effective and efficient way possible. However as Marine Safaris does not have direct control over the service provided by its suppliers, for whom it is acting as an agent, Marine Safaris shall not be liable for charges, omissions, or delays, before or during the course of any Tour, Safari or Package, whether occasioned by technical difficulties, weather conditions, strikes, communication breakdowns, or any other cause whatsoever. Cancellation ClauseIn the event of a cancellation, for whatever reason, you must submit your cancellation in writing and you shall be liable to Marine Safaris for cancellation charges, levied and payable as below: Individual Cancellation60 days or more prior to departure / arrival date 30% of total price Within 60 days of departure / arrival date 100% of total price Group CancellationsIn the event of a cancellation, for whatever reason, you must submit your cancellation in writing and you shall be liable to Marine Safaris for cancellation charges, levied and payable as below:
Inclusive and ExclusivePrices do not include any items or services not specified as being inclusive. Transfers between airports, harbours, hotels as well as entertainment, activities, sports, meals and beverages are not included, unless specified as inclusive. Telephone calls, faxes, e-mail services and all other items of a personal nature are also excluded. Airline & ticket responsibilityThe passenger ticket in use by the airline, when issued, shall constitute the sole contract between the airline and the purchaser and / or the passenger using them. In the event of ticket loss after Marine Safaris has issued them to you a new ticket will have to be purchased by yourself. Notification and verification thereof by yourself and the airline must be obtained in writing and forwarded to Marine Safaris before any implementation for refunds can be submitted, if refunds are applicable. Website, e-mail, e-brochures and Brochure descriptions and offersAll information published on the Marine Safaris Website, Brochures or e-mails is accurately compiled, checked and reconfirmed prior to going to publication, print or distribution and are regularly up-dated where possible. It is however possible that by the time you read the information contained in either of these publications that the information, rates and / or offers contained in them may have varied or may have changed. Medical or Physical conditionsAny medical condition or physical disability requiring special attention or treatment must be advise to Marine Safaris at the time of making your booking. While every effort will be made to comply with these needs Marine Safaris accepts no responsibility or liability should the service provider/s fail to comply with such needs. Service Provider terms and conditionsAll reservations made by Marine Safaris on your behalf with the relevant service providers are subject to the service providers terms and conditions. Marine Safaris cannot be held responsible should you choose not to abide by these terms and conditions imposed by the various service providers. Information on Hotels, Resorts, Lodges, Apartments, Camps and servicesMarine Safaris makes every effort to select accommodation facilities and service providers of a high standard and requests that each service provider ensures that they will provide what they have agreed to provide according to the standard that they offer and which Marine Safaris acts as an agent for. As a result, if you make a claim of poor standard of service, non-availability of service and / or miss-representation, this claim shall be made against the service provider for whom Marine Safaris is acting as an agent, and not against Marine Safaris. Itinerary CancellationMarine Safaris reserves the right to cancel any reservation prior to departure, in which event you will be refunded the entire amount paid by you without prejudice and without further obligation or any further liability to you by Marine Safaris. Travel InsuranceIf you decide not to take this insurance neither Marine Safaris nor it´s agents that do not have direct control over service provided by its suppliers, for whom it is acting as an agent, shall be liable for charges, omissions, or delays, before or during the course of any Tour, Safari or Package, whether occasioned by technical difficulties, weather conditions, strikes, communication breakdowns, or any other cause whatsoever. Validation of ConditionNo variations to or of these conditions shall be valid unless submitted in writing to Marine Safaris and is confirmed and signed by at least two members of Marine Safaris. |
